Town of Kindersley to take possession of commercial lot

KINDERSLEY – The Town of Kindersley council approved the municipality taking ownership of a large commercial lot to address an unpaid property tax bill. The resolution to proceed was passed at the July 27 regular meeting of council.
Councillors heard a presentation from Chief Administrative Officer (CAO) Marty Baroni who noted a key notice period had passed in the tax enforcement matter of Lot 3, Block 2, Plan G776 Extension 0. "It's a very large commercial property," said Baroni during discussion, adding that this file is at one of the final stages of the tax enforcement process.

Readers should note that municipalities may utilize a process under the Tax Enforcement Act to take ownership of properties linked to an unpaid property tax bill. The provincial law notes that the process involves allowing a certain amount of time to pass along with public advertisements and notices and if the debt is still not cleared up, the municipality may move to take ownership of the property in question and attempt to sell it to recover unpaid property tax revenue.
"On June 19, 2026, the 30-day final notice pursuant to The Tax Enforcement Act was deemed served for the following properties: Lot 3, Block 2, Plan G776 Extension 0," stated the staff report.
"The 30-day period from the date the notice(s) was deemed served has expired. Council at this time may authorize administration to proceed with title acquisition. Once authorized by council, the town will request the registrar to issue the property title to the town."
The land description listed at the council meeting corresponds to 108A 12th Avenue East, the now-closed H&G Motel, on a service road immediately adjacent Hwy. #7. The parcel in question is about 35,719 square feet (0.82 acres) in size and is zoned C-3 highway commercial.
Baroni's report to council confirmed the purpose of taking ownership of the lot would be to sell that lot to recover the debt.
It should also be noted that the current property owner has until the title is officially placed in the town's name to pay off the unpaid tax debt and if this is done tax enforcement on that property is halted.
Councillors unanimously passed a resolution to authorize administration to move forward with the municipality taking ownership of the parcel in question.
It should be further noted the now-closed H&G Motel had been designated temporarily closed / unfit for occupation as of April 23, 2026.
