KINDERSLEY – The Town of Kindersley council approved a change to its zoning bylaw and began the process to change another part of it. The resolutions were passed at the Sept. 28 regular meeting of council.

Kindersley council unanimously passed first reading of bylaw 10-26, an amendment of the zoning bylaw, with this legislation being referred to as zoning amendment bylaw (D). The amendment proposes changing the zoning of 604 12 Ave. East from C4 designation to C3. Screenshot

First up was an amendment to the zoning bylaw that already passed first reading, with staff referring to this amendment as zoning amendment bylaw (C). Mayor Ken Francis noted a public hearing was scheduled for this proposed legislation.

At 7:01 p.m. councillors suspended the regular council meeting by unanimous vote and opened the public hearing for zoning amendment (C). Staff checked the front entrance of the municipal office and reported back that no members of the public were present for the public hearing. Councillors then unanimously passed a resolution to close the public hearing and re-open the regular council meeting.

Zoning amendment (C) included a revision of Section 8.10.3, mobile home residential district, in Kindersley’s zoning bylaw.

The new mobile home section included all setbacks that apply to mobile homes in the municipality, and also included sections on rules, regulations and standards that apply to mobile homes in municipal limits.

Under mobile home development standards, one such requirement notes, “Accessory structures, including porches, decks, skirting, sunrooms, and storage buildings, may be factory-prefabricated or site-built, provided they comply with the National Building Code of Canada and the Town’s Building Bylaw.”

Under Mobile home park/court development standards, one requirement stated, “A minimum of ten (10 per cent) percent of the gross area of the mobile home park shall be devoted to communal open space or recreational facilities.”

Under the section “Accessory buildings,” one requirement noted, “All attached and accessory structures shall require a building permit and shall comply with the requirements of the National Building Code of Canada and the Building Bylaw of the Town.”

At a previous council meeting staff observed that changes to this bylaw affecting mobile homes in Kindersley were written along with consultation of mobile home park owners and would help address demand for residential property in Kindersley.

Councillors unanimously passed all of the readings required to bring the bylaw into force.

Councillors also unanimously passed first reading of bylaw 10-26, also an amendment of the zoning bylaw, with this legislation being referred to as zoning amendment bylaw (D). The amendment proposes changing the zoning of 604 12 Ave. East from C4 designation to C3. The staff report noted, “This designation is agreed upon by both the landowner and the Town of Kindersley to more accurately portray what this property is used as/for.”

Zoning amendment bylaw (D) will now be publicly advertised and return for consideration to a future council meeting.
